  • What the hell?

    I just got this email from our new host:

    Hello John!

    We have noticed a number of large media files (ie. movies, music
    files, etc) located under your 'thiahorror' account.

    thehorrorisalive.net/john/relol.zip

    We recognize that many large media files are totally fine (for
    example, we have many customers who share home movies, their
    band's MP3 music files, etc). This sort of thing is great and
    we encourage it.

    However, we've found that some DreamHost customers have used their
    accounts in order to acquire or distribute copyrighted content -
    ie. TV shows, movies, music, etc. in a manner not authorized by
    the copyright holders of those items. As the disk space we offer
    has increased, this has become more and more of a problem.

    Such copyright infringement is strictly against our Terms of
    Service, and can result in disablement without warning or refund.

    Even worse, it can expose people to significant legal trouble if
    the copyright owner finds out about it!

    This is just a friendly request that you make sure that you either
    own the copyright for any files you are distributing or acquiring
    in connection with your account, or you have obtained permission
    from the copyright holder to distribute them. If you have any such
    content under your account, remove it as soon as possible.

    Here are answers to a few common questions we receive:

    Q: "Does this apply to anime and/or fansubs?"

    A: Yes. There is no distinction between anime and other copyrighted
    content, and as Japan is a signatory of the Berne Convention such
    files are protected no differently than that from the United
    States. This applies even to "unlicensed" material (after all, if
    you can legally distribute such material without permission, why
    would a company bother to obtain a distribution license in the
    first place?).




    Q: "What if I'm not making money from it?"

    A: Though the penalties may be stiffer for the former, when it comes
    to its legality copyright law holds no distinction between
    commercial and non-commercial copyright infringement. Both can
    lead to civil or criminal legal action, and both are prohibited
    in conjunction with our services.

    Q: "What about Fair Use?"

    A: Copyright law does allow for the "Fair Use" of portions of some
    content, but this exemption is far more limited than many people
    believe. You can, for example, quote small portions of someone's
    weblog posting, but you can't (as another common example)
    redistribute a full-length animated feature with the addition of
    subtitles. If you're unsure of whether something falls under Fair
    Use, we suggest that you contact a qualified intellectual law
    attorney. The following Wikipedia article is also informative.



    Q: "Do you allow the use of BitTorrent, iroffer, etc?"

    A: We do not allow BitTorrent, iroffer or other persistent, server
    type processes on our shared hosting plans. Even though there are
    non-infringing uses for such tools, there are other administrative
    reasons why they are not allowed. If you use such tools, please
    disable them as soon as possible.

    What the hell times two thousand! The god damn file isnt even that large, its a freaking joke video I captured myself from a video game....what in the flying hell!?

    Its called them covering their asses, and yours. Its not a warning to Cease and Desist, nor are they telling you to remove it, they are just making you aware of what COULD happen if you did put illegal material up. I dont see anything to worry about in it really.

        Exactly, I sent a WTF email back and got a response about it being a bot that prowls around on the site looking for suspicous files...-_-'

          @ Dot50Cal: Your name is John?

          This email is just telling you that they had members (before you register) using their services for some illegal purposes, and ask you not to do the same things, not mean that you are absolutely the suspect/criminal.

          don't worry, just a letter to tell you their rules, because u use their services. so they are telling you what to obey from them.

                    Stop worrying so much lol. Its absolutely nothing. They saw big files being sent, so it is their job to protect themselves, and you, by sending an email to just warn what would happen if that file is an illegal file.

                      I still dont appreciate it, it means they actively monitor their hosted websites for stuff and will snoop into files whenever they please. They are just pissed off that I am using the space/bandwidth they are providing. Thats whats concerning me.

                        They dont snoop anything, Im sure it was in the contract that you agreed to in the first place. They are doing exactly what any other webhost out there does, because they still have to follow the laws, Internet or not. You ARE running off of their servers, after agreeing to a plan that Id assume has something in it about the DMCA and all that. A bot picking up on a file size doesnt really matter now, does it?

                            Thats just an example file, Im sure the record everything you do heh. Basically what im getting at, is the fact that its normal for any webhost to do it really, bar hosting your own dedicated, but even then the ISP monitors that.
